Five years ago, we presented to you our new investment under the name Start Park, located in a unique area of Wrocław, within the sports and recreation complex near the Olympic Stadium.
During the project’s implementation phase, following the issuance of the final building permit decision No. 842/2021 dated 16 March 2021, issued by the Mayor of Wrocław, the investment became subject to an extraordinary control procedure. During this process, the Lower Silesian Voivode, and subsequently the Chief Building Control Inspector, declared the building permit invalid, erroneously assuming that the decision had been issued in gross violation of the law. As a result, the implementation of the investment was temporarily suspended.
The company challenged these rulings, consistently defending the correctness of the issued permit. The matter was ultimately reviewed by the Supreme Administrative Court, which, by its final judgment of 4 November 2025, case file II OSK 1253/23, annulled the decisions of the authorities declaring the building permit invalid and restored this permit to legal effect. This judgment is binding for administrative bodies and courts, is final and unappealable, and constitutes the ultimate decision in the matter. This position was subsequently confirmed by the Lower Silesian Voivode in the decision dated 17 March 2026, refusing to declare the building permit invalid.

On 19 March 2026, the SOS Wrocław Association submitted a request to revoke the building permit under the extraordinary procedure specified in Article 161 § 1 of the Code of Administrative Procedure. Article 161 § 1 CAP is extraordinary in nature and may apply only to strictly defined, exceptional grounds, such as a situation threatening human life or health, serious damage to the national economy, or important interests of the State.
None of the above grounds are present in this case, which makes the attempt to apply this procedure completely unfounded.
In practice, this means that this procedure cannot be used as an alternative to concluded proceedings regarding the legality of administrative decisions.

We would like to inform you that the Supreme Administrative Court, in its judgment of November 4, 2025, ref. no. II OSK 1253/23, overturned the judgment of the Provincial Administrative Court in Warsaw of January 26, 2023. ref. no. VII SA/Wa 1914/22, and the decisions of the first and second instance authorities regarding the invalidity of decision no. 842/2021 of March 16, 2021 of the Mayor of Wrocław granting Dolnośląskie Inwestycje S.A. S.K.A. a building permit for a student dormitory with commercial premises at ul. Paderewskiego 35 in Wrocław (plot no. 1/8, Zalesie district).
As a result, the final and legally binding building permit decision No. 842/2021 of March 16, 2021, has been reinstated, and the Company is therefore entitled to commence construction works on the basis of the above decision.
At the same time, the Company would like to emphasize that it has a conservation permit for the planned investment (decision of the Municipal Conservator of Monuments in Wrocław of September 7, 2020, No. 808/2020), which was attached to the application for a building permit at the stage of its acquisition. In its judgment of November 24, 2023, the Provincial Administrative Court in Warsaw, file ref. no. VII SA/Wa 1891/23, stated that “the expiry of the period specified in the conservation permit does not mean that the decision ceases to be valid in legal transactions, The conservation permit is subject to consumption and remains valid as long as the building permit decision remains in legal use.”
The above rulings of administrative courts in the case of the Company’s investment confirm the full compliance of the planned investment with the applicable regulations, and the legal assessment contained therein is binding on courts, public administration bodies, and parties to the proceedings.
In light of this situation, the Company announces that it intends to proceed with an investment project involving the construction of a student residence with commercial premises at ul. Paderewskiego 35 in Wrocław. We would like to assure you that START PARK remains an investment prepared with the utmost care, both in terms of architecture and legal formalities, and our goal is to create a functional, aesthetic space that fits in with the character of the district and will serve future residents and the local community.
