Rent regulations

Regulations concerning the conclusion and performance of lease agreement for STARTER micro apartments for residential purposes.

 

 

1. General provisions

The Regulations specify the conditions of reserving and renting the micro apartments located in the building on 18 Wybrzeże Ludwika Pasteura Street in Wrocław offered by the landlord, i.e. Dolnośląskie Inwestycje Spółka Akcyjna with registered office in Wrocław on its website www.starter.net.pl and on websites www Booking.com and HRS – HOTEL RESERVATION SERVICE. By making a reservation the tenant states that he has read and accepted the provisions of the Regulations. Making a reservation constitutes the conclusion of the lease agreement between Dolnośląskie Inwestycje S.A., as the landlord, and the person that has made the reservation, as the tenant, under the terms and conditions specified in these Regulations and the rental offer of the particular micro apartment placed on the website www.starter.net.pl.

The landlord reserves the right to reject the reservation.

2. Information about the landlord

The landlord is the company Dolnośląskie Inwestycje S.A. with registered office in Wrocław, Wybrzeże Ludwika Pasteura 18/1I, 50 – 367 Wrocław, entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court for Wrocław-Fabryczna, VI Commercial Division, under the KRS number: 0000407903, NIP number 8982199213, REGON number 8982199213, with the share capital of PLN 100 000.

The landlord will contact the tenant via email or by telephone using tenant’s email address and telephone number indicated upon reservation or in person by the customer.

3. Lease agreement

The agreement concluded between Dolnośląskie Inwestycje S.A. and the Lessee relates only and exclusively to the lease of the micro apartment together with its equipment, as described on the website www.starter.net.pl, for a definite period of time. The rent includes utility payments (electricity, water) and the final cleaning. Dolnośląskie Inwestycje S.A. shall not charge any additional fees above those indicated on the website of the particular micro apartment and in these Regulations.

4. Reservation

Reservations can be made using the reservation form on the landlord’s websites: Booking.com and HRS – HOTEL RESERVATION SERVICE.
In order to make a reservation provide the information specified in the reservation form:

  • estimated arrival date and the number of nights,
  • estimated arrival time,
  • number of people in the apartment,
  • first name and last name,
  • address,
  • telephone number,
  • email address,
  • invoice information, if required.

5. Reservation guarantee

Micro apartments reservation is made upon the payment for the whole rental period.
The rent shall be paid in full and in advance:

  • by charging the Customer’s credit card given by the Customer upon making the reservation

or

  • by making an online payment to the following bank account:

In case of a change or cancellation of the reservation, the person that has made the reservation shall be charged the full cost of the rental time reserved. In case the tenant does not report to collect the keys to the apartment, the tenant shall be charged full cost of the rental time reserved.

6. The start and the end of the residency in the micro apartment (check-in/check-out)

The check-in time is from 2 PM on the first day of rental to 12 AM on the last day of rental.

Early check-in: depending on the availability of the micro apartments there is a possibility of an early check-in after consulting the landlord.
Late check-out: depending on the availability of the micro apartments there is a possibility of a later check-out for an extra charge:

  • Extension of the check-out time to 2 PM – an additional fee of 25% of the cost of the last day reserved,
  • Extension of the check-out time to 6 PM – an additional fee of 50% of the cost of the last day reserved.

7. Registration and the rules of collecting the apartment keys

The registration procedure requires the tenant to show a photo ID.

  • The landlord reserves the right to refuse to hand over to the tenant the apartment keys, if the tenant:
    does not have a valid ID card or refuses to show the document, or is under the influence of alcohol or other drugs.

The landlord’s Reception Office hours:
Monday – Friday: 9 AM – 5 PM

The apartment keys may be collected during office hours indicated above or at the 24-hour concierge service located in the area of Starter facility.

The keys may be collected after making the payment for the whole rental time reserved.

8. Check out and returning the micro apartment with the keys

The micro apartment and the keys shall be returned as agreed with the Reception Office employee.

In case of losing the micro apartment keys the tenant is obliged to pay the fee of PLN 100.
In case the tenant does not return the micro apartment on the last day of renting, the tenant is obliged to pay a contractual penalty to the landlord in the amount of the double daily rent, applicable on the day of making the reservation, for each day of delay.

The landlord may also require to pay the compensation exceeding the amount of the contractual penalty indicated above.

9. Curfew

Tenant are obliged to respect other residents and in particular to respect the rules of the night curfew from 10 PM to 6 AM.
In case of a serious violation of the principles of the curfew, the landlord has the right to terminate the lease with immediate effect without the notice period and without reimbursement of rent paid in advance.

10. Responsibility for the micro apartment

Tenants are obliged to return the micro apartment in the same condition as one in place upon arrival.
In case of damage to the apartment tenants are obliged to pay in cash the compensation fully covering the value of the losses incurred, at the latest on the day of the check out, in the Reception Office or to the employee responsible for the keys.

Tenants are obliged to close all windows and lock the door every time they leave the micro apartment.

In case of damage to the apartment, the furnishing, the appliances or the building done by the tenants as well as in case of use of the apartment by the tenant for purposes other than intended, the landlord has the right to terminate the lease with immediate effect without the notice period. In that case the tenant shall not be entitled to any reimbursement of rent paid in advance.

11. Smoking ban

Smoking is prohibited in the micro apartments and in the whole building. A violation of this ban may result in a fine of PLN 1000.

 

12. Pets

Pets are not allowed.

13. Force majeure and emergencies

In case of occurrence of circumstances impossible to predict the effects of which cannot be immediately eliminated by conventional means, the landlord reserves the right to propose the tenant a replacing micro apartment which is not worse than the originally reserved. In case of the tenant not agreeing for the change of the micro apartment, the rent paid in advance shall be returned immediately following the deduction of the amount due for the period until the day the tenant leaves the apartment.

 

14. Failures

The tenant is obliged to immediately report any failures in the micro apartment to the Reception Office or to the 24-hour concierge service.
The landlord undertakes to fix any malfunction in the micro apartment without undue delay within a maximum of 24 hours from the moment it is reported, unless the nature of the malfunction requires a longer repair time.

15. Personal data

Personal data provided by the tenants to the landlord will be processed only to make a reservation and to implement a rental service and possibly to send information concerning promotional activities of the landlord.
The tenant may opt out of receiving information about landlord’s promotional campaigns.

16. Complaints

Complaints concerning payment transactions and the implementation of rental service should be reported to the landlord’s registered office address or the email address specified in point 2 of the Regulations.
Complains will be reviewed by the landlord on an ongoing basis, but not later than within 14 days from the date of the receipt of the complaint by the landlord.

The landlord reserves the right to extend the above-mentioned time limit for the examination of a complaint – by no more than 10 days – if the examination of the complaint requires specific actions or arrangements or if the landlord encounters obstacles independent and not caused by the landlord (equipment failures, internet failures etc.).

An answer to a complaint will be sent to the person submitting the complaint using the contact details provided in the complaint form.

17. Dispute resolution

In case of any disputes between the landlord and tenant the Polish law shall be applicable.

18. Final provisions

The number of residents in the micro apartment shall not be greater than the number specified in the registration card. If this number is exceeded, the landlord has the right to terminate the lease with immediate effect without the notice period and without reimbursement of rent paid in advance.
